The “aggregate-of-interests” approach, meaning that each property interest is valued individually and separately in an eminent domain action, is required by the Utah Code. The valuation may be done as part of a single court action with other property interests, or in a separate action.

A lease can be a property interest that is evaluated separately from the land itself in an eminent domain action.
