New Disclosure Materials for Condemning Agencies

In accordance with our statutory mandate, the Office of the Property Rights Ombudsman prepares and updates materials educating property owners about their rights if a condemning agency seeks to acquire some or all of their property.

We have recently published new versions of these materials, titled “Your Guide to Just Compensation” on our website. All state agencies, local governments, or private entities that undertake a project potentially condemning any property must provide this publication to property owners. For convenience, these materials exist in both a full-page version and a brochure version on the website.

The attorneys in the Ombudsman’s office are happy to answer questions about these disclosures or to otherwise assist property owners and condemning agencies in understanding the legal requirements and best practices for eminent domain in Utah.
